Hydraulic fracturing could begin in New York within 2010 unless the state legislature acts now. The State Senate gave us an overwhelming, bi-partisan victory when they passed the moratorium on August 3. Now it's the Assembly's turn! Dear Governor Paterson, Assembly Speaker Silver, and Assembly member Sweeney,

New York's precious water and other natural resources will be confronting their greatest risk in many years if the pending proposal for industrial gas drilling is allowed to proceed based on the Department of Environmental Conservation's fatally flawed draft environmental impact report.

Legislation is pending in both the Senate and Assembly that would prohibit industrial gas drilling until further analyses into its safety have been conducted. If the legislative session is allowed to adjourn without action on these bills, the DEC could move forward with permitting new gas drilling based on the draft environmental impact study and without an appropriate set of protective regulatory measures.

Please work with your colleagues to ensure that legislation is enacted this session suspending any new permitting for drilling in the Marcellus Shale until the risks to the state's drinking water, air quality, landscapes and health have been properly examined, and a determination is made as to whether and if so how those risks could be adequately managed.
